ChatterFork Inc. (“ChatterFork,” “we,” “us,” or “our”) respects your privacy and values the trust you place in us.

This Privacy Policy describes the personal information we collect through the ChatterFork mobile application, website, restaurant dashboard, creator tools, analytics features, and related services collectively referred to as the “Platform.” It also explains how we use, disclose, retain, and protect that information and the choices available to you.

This Privacy Policy does not apply to third-party websites, applications, or services that operate independently from ChatterFork. Certain information submitted by restaurants, creators, business partners, or service providers may also be governed by a separate agreement with ChatterFork. When a separate agreement applies, we will process the covered information in accordance with that agreement and applicable law.

1Information We Collect Through the Platform

We collect information that you provide directly, information collected automatically when you use the Platform, information received from third parties, and information generated through your interactions with ChatterFork.

Personal Information You Provide

ChatterFork may collect personal information when you create an account, establish a profile, publish content, claim or manage a restaurant page, participate in creator programs, contact us, or otherwise use the Platform.

Examples include:

  • Name, email address, username, password, and profile photograph
  • Account settings and communication preferences
  • Videos, photographs, audio, captions, ratings, reviews, comments, hashtags, and other content you submit
  • Dish names, restaurant names, dining locations, visit information, and other details associated with your posts
  • Flavor preferences, taste ratings, food interests, saved dishes, and restaurant preferences
  • Messages and other communications sent through the Platform
  • Restaurant ownership, employment, authorization, and business contact information
  • Creator account, participation, and analytics information
  • Customer service requests, complaints, and other communications with us
  • Information submitted through surveys, promotions, contests, waitlists, or beta programs

When payments, subscriptions, creator rewards, or other financial transactions are available, payment information may be collected directly by a third-party payment processor. ChatterFork may receive limited transaction information, such as payment status, transaction amount, subscription status, and a payment method identifier. ChatterFork does not intend to store complete payment card numbers.

Creators or other users receiving payments may also be asked to provide payment, identity verification, banking, or tax information to ChatterFork or its payment providers.

Information Collected Automatically

When you access or use the Platform, we and our service providers may automatically collect information such as:

  • IP address
  • Browser type and browser characteristics
  • Device type, manufacturer, and model
  • Operating system and application version
  • Device identifiers and advertising identifiers
  • Language, country, time zone, and general device settings
  • Dates and times you access the Platform
  • Pages, screens, videos, dishes, restaurants, and features you view
  • Search terms, clicks, likes, follows, saves, shares, watch activity, and other interactions
  • Referring and exiting pages
  • App performance information, diagnostics, and crash reports
  • Content metadata, including upload date, file type, and technical information
  • Approximate location derived from your IP address

With your permission, ChatterFork may also collect precise or device-based location information to provide features such as nearby restaurant discovery, maps, location-based recommendations, or identification of restaurants near you. You can disable device location access through your device settings, but some Platform features may not work properly.

Cookies and Similar Technologies

We and our service providers may use cookies, software development kits, pixels, web beacons, local storage, server logs, and similar technologies.

These technologies may be used to:

  • Keep you signed in
  • Remember your settings and preferences
  • Maintain Platform security
  • Understand how people use the Platform
  • Measure content and feature performance
  • Diagnose technical problems
  • Improve recommendations and search results
  • Measure the effectiveness of communications or promotions

You may be able to delete, block, or restrict cookies through your browser or device settings. Restricting these technologies may affect the availability or functionality of certain Platform features.

Because there is not currently a uniform industry standard for browser-based “Do Not Track” signals, the Platform may not respond to all such signals. Where required by applicable law, we will recognize supported opt-out preference signals, such as the Global Privacy Control.

Information Received from Third Parties

ChatterFork may receive information from third-party services when you connect an account, use an integrated feature, follow a link, or interact with a ChatterFork partner.

These third parties may include:

  • Social media and account-login providers
  • Mapping and geolocation providers
  • Restaurant reservation, ordering, or menu providers
  • Payment and payout processors
  • Analytics and application-performance providers
  • Restaurants, creators, brand partners, and business partners
  • Publicly available restaurant or business information sources

The information we receive depends on the third-party service, the permissions you provide, and your settings with that service. Third-party services process information under their own privacy notices.

User Content, Video, Audio, and Images

ChatterFork is a food discovery platform that allows users, creators, restaurants, and other authorized parties to upload or publish videos, photographs, audio, ratings, reviews, and related information.

We may use automated tools to process this content to:

  • Transcribe spoken words
  • Recognize or extract visible text
  • Identify food-related subjects, dishes, menus, or restaurant information
  • Categorize content and generate tags
  • Match content with a restaurant, dish, cuisine, or location
  • Recommend content, restaurants, dishes, or users
  • Detect duplicate, fraudulent, unsafe, or prohibited content
  • Assist with content moderation and Platform security

We may also generate information about your likely food interests and preferences based on your ratings, reviews, selected flavor attributes, searches, viewing activity, follows, saves, and other interactions. This information may be used to create or update your taste profile and improve recommendations.

Content you publish may be used to create, update, or enhance restaurant pages, dish pages, creator profiles, geographic pages, search results, and other discovery features. Public content and related pages may be accessible without a ChatterFork account and may be indexed by search engines or surfaced through third-party services.

Videos or photographs may incidentally include individuals in restaurants or other public environments. Users and organizations that upload content are responsible for having the rights, permissions, and consents necessary to submit and publish that content.

ChatterFork does not currently use facial recognition to identify individuals who incidentally appear in user-submitted content. If our practices materially change, we will update this Privacy Policy and provide any additional notice or consent required by law.

Sensitive Personal Information

Some information we collect may be considered sensitive, including precise location information, account login credentials, and banking, tax, or identity verification information provided for creator payouts or other payments.

We use sensitive personal information only as reasonably necessary to provide the Platform and the features you request, process transactions and payouts, verify identity, maintain security, prevent fraud, and comply with law. We do not use sensitive personal information to infer characteristics about you, and we do not sell or share it for targeted advertising.

Deidentified and Aggregated Information

We may create aggregated, statistical, or deidentified information from the information described in this Privacy Policy. We may use and disclose this information for analytics, research, product development, reporting, restaurant insights, and other legitimate business purposes.

When required by law, we will take reasonable steps to prevent deidentified information from being associated with a particular individual or household.

We may use the information we collect to:

  • Create, maintain, secure, and administer user accounts
  • Provide the Platform and its features

  • Create and improve user taste profiles and similarity recommendations
  • Provide analytics and insights to creators and restaurants
  • Process subscriptions, payments, creator rewards, and other transactions
  • Provide maps, nearby discovery, and location-based features
  • Respond to questions, requests, complaints, and customer service inquiries
  • Send administrative, transactional, and service-related communications
  • Send marketing communications when permitted by law
  • Conduct surveys, promotions, beta programs, and research
  • Operate, evaluate, test, and improve the Platform
  • Develop new products, services, and Platform features
  • Monitor Platform performance and diagnose technical problems
  • Moderate content and enforce our Terms of Use and community standards
  • Detect and prevent fraud, spam, abuse, unauthorized activity, and security incidents
  • Protect the rights, safety, privacy, and property of ChatterFork, our users, restaurants, creators, and others
  • Establish, exercise, or defend legal claims

If we intend to use personal information for a materially different purpose, we will provide additional notice and obtain consent where required.

3How We Disclose Personal Information

  • Restaurants and dishes associated with your posts
  • Likes, follows, saves, or other public interactions
  • Creator or restaurant account information
  • Public dish, restaurant, creator, or geographic pages generated from your content

Other users may share or capture public content outside ChatterFork. We cannot control information after it has been copied, downloaded, indexed, or shared by another person or third-party service.

Service Providers

We may disclose personal information to service providers that perform services on our behalf, including:

  • Cloud hosting and data storage
  • Content delivery
  • Account authentication

We require service providers to process personal information only for authorized purposes and subject to appropriate contractual restrictions.

Restaurants, Creators, and Business Partners

We may provide restaurants, creators, and business partners with analytics or insights about how users interact with their pages or content.

These insights may include information such as:

  • Content views and engagement
  • Search and discovery trends
  • Aggregate user interests
  • Popular dishes and flavor attributes
  • General geographic or audience information
  • Promotion or campaign performance

We generally provide this information in aggregated or deidentified form unless you direct us to share your information, the disclosure is necessary to provide a requested feature, or another lawful basis applies.

Third-Party Integrations

When you choose to connect with or use a third-party service through ChatterFork, we may disclose information necessary to complete your request. Information disclosed to a third party is governed by that third party’s privacy practices.

Legal, Regulatory, and Safety Disclosures

We may disclose information when we reasonably believe disclosure is necessary or appropriate to:

  • Comply with a law, regulation, subpoena, court order, or other legal process
  • Respond to a lawful request from law enforcement or a regulatory authority
  • Investigate suspected fraud, abuse, illegal activity, or a security incident
  • Prevent physical harm, financial loss, or other serious injury

Business Transfers

Personal information may be disclosed or transferred as part of a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction.

Where appropriate, we will take reasonable steps to require the recipient to process personal information consistently with this Privacy Policy and applicable law.

With Your Direction or Consent

We may disclose information when you direct us to do so, authorize a connection with another service, participate in a feature that requires disclosure, or otherwise provide consent.

Sale and Targeted Advertising

ChatterFork does not sell personal information in exchange for monetary payment and does not rent personal information.

Some state privacy laws define “sale,” “sharing,” or “targeted advertising” more broadly than an exchange for money. If our use of cookies, SDKs, advertising technologies, or business partnerships falls within one of those definitions, we will provide any notice and opt-out rights required by applicable law.

If we begin using personal information for targeted advertising, or in any way that qualifies as a sale or sharing under applicable law, we will provide a clear opt-out link on the Platform before doing so.

4Your Rights and Choices

Account and Profile Information

You may review or update certain account and profile information through your Platform settings.

You may request closure of your account by using the available account controls or contacting us at privacy@chatterfork.com.

  • Must be retained for legal, fraud-prevention, security, or dispute-resolution purposes
  • Appears in deidentified or aggregated information
  • Is contained in backup systems awaiting scheduled deletion

We will take reasonable steps to remove or deidentify account information in accordance with our retention practices and applicable law.

  • Delete or block cookies
  • Reset device identifiers

  • Confirm whether we process your personal information
  • Access personal information we maintain about you
  • Obtain a portable copy of certain personal information

To submit a privacy request, contact privacy@chatterfork.com.

Please describe the request and provide enough information for us to identify your account and verify your identity. We may request additional information when reasonably necessary to verify a request and protect against fraudulent access.

Where permitted by law, an authorized agent may submit a request on your behalf. We may require evidence of the agent’s authority and may separately verify your identity.

We will confirm receipt of your request within 10 business days and respond within 45 days. If we need more time, we will tell you why and may extend the response period by up to an additional 45 days where permitted by law. • Destruction
  • Loss
  • Alteration
  • Access
  • Disclosure
  • Acquisition
  • Misuse

Our safeguards may include access controls, authentication measures, encryption, monitoring, secure development practices, service-provider reviews, and incident-response procedures, as appropriate to the nature of the information and our operations.

No security safeguard, application, or Internet transmission can be guaranteed to be completely secure. You are responsible for maintaining the confidentiality of your account credentials and notifying us if you believe your account has been compromised.

6How Long We Keep Personal Information

We retain personal information for as long as reasonably necessary to:

  • Provide and maintain the Platform

  • Maintain business and financial records
  • Comply with legal and regulatory requirements
  • Resolve disputes

The retention period may depend on the type of information, how it is used, whether your account remains active, and whether retention is required for legal, operational, safety, or security purposes.

We generally apply the following criteria to each type of information:

  • Account and profile information: kept while your account is active and deleted or deidentified after your account is closed, unless needed for legal, security, or fraud prevention purposes
  • Content you publish: kept until you delete it or close your account, except copies already shared by others or content we must retain for legal reasons
  • Precise location information: kept only as long as needed to provide the location-based features you have enabled
  • Payment, payout, and tax records: kept for as long as required by tax, accounting, and financial recordkeeping laws
  • Usage, device, and log information: kept as long as needed for security, diagnostics, analytics, and Platform improvement, then deleted or deidentified
  • Communications with us: kept as long as needed to respond to you and maintain a record of the interaction
  • Waitlist, survey, and beta program submissions: kept as long as needed to run the program, or until you ask us to remove them

When personal information is no longer reasonably necessary, we may delete, anonymize, or deidentify it. Information contained in backup systems may remain until the relevant backup is overwritten or securely deleted through our normal retention cycle.

7Children’s Privacy

The Platform is not directed to children under 13 years of age, and ChatterFork does not knowingly collect personal information from children under 13 without legally sufficient parental consent.

If we learn that we have collected personal information from a child under 13 in circumstances not permitted by law, we will take reasonable steps to delete the information.

We do not sell or share the personal information of users we know are under 16 years of age.

A parent or legal guardian who believes a child under 13 has submitted personal information to ChatterFork may contact us at privacy@chatterfork.com.

Users between the ages of 13 and 17 may use the Platform only when permitted by applicable law and our Terms of Use. We may restrict certain features or require parental or guardian involvement where legally required.

8Links, Embedded Content, and Third-Party Services

The Platform may contain links to, integrations with, or content provided by third-party websites and services, including maps, reservation providers, restaurant websites, ordering services, payment services, and social media platforms.

These third parties operate independently from ChatterFork. Their collection and use of information are governed by their own privacy notices, terms, and settings.

ChatterFork is not responsible for the content, security, availability, or privacy practices of third-party services. We encourage you to review the privacy notice of any external service before providing information or using its features.

9International Users

ChatterFork is based in the United States. If you access the Platform from another country, your information may be transferred to, processed in, or stored in the United States or another country where ChatterFork or its service providers operate.

These countries may have privacy laws that differ from those in your jurisdiction.

Where required by applicable law, we will use appropriate safeguards for international transfers of personal information.
